CALIFORNIA APPEALS COURT RULES AGAINST GROWER FOR SAME ACTIONS DISMISSED IN MONTREAL LAST WEEK
The Associated Press reports that a California state appeals court upheld a lower court ruling Thursday that Proposition 215 does not grant a medical marijuana grower immunity from prosecution. In contrast, a Montreal Court ruled last week that medical marijuana has to come from somewhere and if the government won’t provide it then it can't prosecute those who do provide it.

The American Civil Liberties Union sued the State Police and Barbour County Sheriff's Department for establishing a drug checkpoint last year near a rally organized by marijuana-law reform advocates.

DAVID NICK WANTS LONG BEACH DA OFF THE CASE
San Francisco attorney J. David Nick filed a motion charging that the Long Beach branch of the Los Angeles district attorney's office "are involved in a moral war where they take personal issue against marijuana use for medicinal reasons." Nick argued the Long Beach branch must be recused "because they have a particular ax to grind against lawful medical marijuana users…"
